1. General provisions
1.1. This Privacy Policy is addressed to users of the website at www.bitx.pl.
1.2. The policy defines the rules for the collection and processing of personal data obtained by the Administrator both when registering an account on the Website, using the website, and also when contacting the service as well as within the framework of conducted marketing activities.

3. Legal basis for the processing of personal data
3.1. Your personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (hereinafter referred to as the GDPR).
3.2. The legal basis for the processing of your personal data by the Administrator is:
- a) your consent (Article 6 (1) (a) of the GDPR);
- b) the need to perform contracts concluded by you with the Administrator, as well as to take action before concluding the contracts at your request (Article 6 (1) (b) of the GDPR);
- c) processing is necessary to fulfill the legal obligation incumbent on the Administrator (Article 6 (1) (c) of the GDPR).
3.3. Providing your personal data on the basis of the above-mentioned point a) and b) is voluntary, however, refusal to provide data will prevent you from using the Website and the services provided electronically by the Administrator.
3.4. The Customer's personal data may be processed in connection with the legitimate interest of the Administrator in order to secure and pursue claims.
4. Purposes and scope of personal data processing
4.1. The personal data provided by you will be processed:
- a) for the purpose and to the extent necessary in connection with the conclusion and performance of the contract or in order to take action at your request before concluding the contract,
- b) in order to fulfill the legal obligation incumbent on the Administrator (resulting, for example, from accounting regulations and tax regulations),
- c) for purposes resulting from the legitimate interests pursued by the administrator (i.e. securing and pursuing claims, direct marketing of own products and services).
As part of direct marketing, the Administrator is authorized to send the User notifications, commercial information, and marketing messages via electronic channels, including in particular using the WhatsApp instant messenger (WhatsApp Business API) and SMS messages. The User has the right to withdraw consent to marketing communication or object to such processing at any time by sending an e-mail to: partner@bitx.pl with the subject "Resignation from WhatsApp/SMS" or by using the opt-out feature within the messenger interface.
4.2. In the above scope, the Administrator will process the following data provided by you: e-mail address, name, surname, company name, telephone number, address (country, zip code, city, street, house / flat number), tax identification number, cookies, IP number, as well as usernames on the social media profiles and messengers used.
5. Providing personal data
5.1. Your personal data will be made available to competent state authorities or third parties, if such an obligation results from generally applicable law.
5.2. The administrator processes personal data coming directly from you (data subjects).
5.3. The administrator provides your personal data to entities providing hosting services, CRM system operators, technological partners providing official messenger API solutions (e.g., WhatsApp Business API / Wazzup), and entities from the IT industry maintaining the website.
5.4. Personal data will be transferred to Bitrix when you use the "live chat with a consultant" service.
5.5. The administrator is responsible for your personal data processed on official profiles in social networking sites (including Facebook.com). To the extent that your personal data is processed by the Administrator in the above-mentioned websites - this Policy applies.
6. Data protection
6.1. The Administrator is obliged to protect user data collected during a visit to the Website in accordance with applicable regulations and in accordance with the highest standards of security and data protection.
6.2. The administrator ensures the security of personal data thanks to the implemented appropriate technical and organizational measures aimed at preventing unlawful data processing and their accidental loss, destruction and damage. The administrator takes all possible measures to ensure that the personal data is correct, processed lawfully, obtained only for specific purposes, safely stored, and not transferred without adequate protection.

Personal data collected in order to conclude or perform a contract and to fulfill a legal obligation by the Administrator are stored for the period necessary to secure or pursue any claims arising from the contract or to comply with a legal obligation. The data of people who set up an account on the Website are processed until the account is deleted from the portal. Data processed for marketing purposes will be processed until the prior consent for their processing for this purpose is withdrawn or until an objection is raised.
